TERMS & CONDITIONS
1. Overview
The present Terms and Conditions constitute the contractual agreement between Sail & Stay Privé (“the Company”, “We”, “Our”, “Us”) and the customer (“You”, “Your”, “Passenger”, “Guest”), governing the booking and participation in our sailing and accommodation experiences.
By confirming a booking, the customer acknowledges and agrees to these Terms and Conditions.
2. Booking Process
2.1. Direct Booking
A booking is considered confirmed only upon receipt of the required down payment and a written confirmation from Sail & Stay Privé. The booking agreement becomes binding once the payment is processed.
2.2. Booking via Third-Party Providers
Customers booking through third-party providers (e.g., travel agents, booking platforms) remain subject to these Terms and Conditions. In case of discrepancies between third-party terms and those of Sail & Stay Privé, these Terms take precedence.
3. Payments
To secure a booking, the customer must make a down payment of 40% of the total price.
Full payment must be made at least 30 days before departure. For any bookings made less than 30 days before departure, full payment is required at the time of booking.
Payments can be made online via credit card or bank transfer.
For day trips, cash payment is possible for bookings made 5 days or less before departure.
4. Costs
The booking price follows an all-inclusive approach, covering all essential trip expenses. However, onshore meals, personal expenses, and extra activities remain the responsibility of the customer.
5. Cancellation Policy
5.1. Cancellation by the Customer

1 to 15 days before departure: 100% of the total price is due.

15 to 30 days before departure: 50% of the total price is due.

31+ days before departure: The down payment (40% of total price) is non-refundable.

Failure to show up on the day and more than 2 hours after the scheduled departure time without prior notice will be considered a cancellation by the customer, and the full amount will be due.
5.2. Cancellation by Sail & Stay Privé
If the company cancels a trip, customers can choose between:

Rescheduling at no additional cost.

A full refund.
5.3. Force Majeure
If a trip is cancelled due to force majeure (e.g., extreme weather, government restrictions), customers will receive a voucher for 50% of the total amount paid, redeemable for a future booking with Sail & Stay Privé or a hotel partner.
6. Amendments
6.1. Amendments by the Customer
Customers wishing to change a booking must notify Sail & Stay Privé in writing. Any amendments are subject to availability and may incur an administration fee.
6.2. Amendments by Sail & Stay Privé

The Company reserves the right to replace the vessel with an equivalent one if necessary.

The Company may replace crew members without affecting the trip price or entitling customers to refunds.

Check-in times are as stated in the booking agreement but may be adjusted without compensation.
7. Travel Insurance
Customers are strongly advised to purchase comprehensive travel insurance, covering trip cancellations, medical emergencies, and personal liability. Sail & Stay Privé is not responsible for any costs resulting from unforeseen incidents.
8. Health & Safety

Customers must comply with safety instructions provided by the skipper or crew.

The skipper has full authority to make decisions in the interest of safety, including route adjustments and activity modifications.

Customers with pre-existing medical conditions should inform the Company before booking.
9. Photography & Promotional Use
By participating in a trip, customers grant Sail & Stay Privé permission to use photos and videos taken during the experience for promotional purposes (website, social media, marketing materials). If a customer wishes to opt out, they must notify the Company in writing before departure.
10. Liability

The Company is not liable for personal injury, loss, or damage to personal belongings during the trip.

The customer is responsible for any damage caused to the vessel due to negligence.

The Company reserves the right to deny service to any customer acting in a disruptive manner.
